1. Acceptance of Terms

By downloading, installing, or using the Bomee mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Bomee is an AI-powered image generation application that allows users to:

• Generate images from text descriptions using artificial intelligence
• Transform existing images using AI-powered image-to-image generation
• Save and organize generated images in a personal gallery
• Customize user settings and preferences

3. User Accounts and Responsibilities

3.1 Account Creation

You may create a user profile with a username. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3.2 User Conduct

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, or offensive
• Create images that violate intellectual property rights of others
• Generate content that promotes violence, discrimination, or hate speech
• Attempt to reverse engineer or compromise the App's security
• Use the App for any commercial purpose without our written consent

4. Intellectual Property Rights

4.1 App Ownership

The App, including its design, functionality, and underlying technology, is owned by us and protected by intellectual property laws.

4.2 Generated Content

You retain ownership of the images you generate using the App. However, by using our service, you grant us a non-exclusive, royalty-free license to use your input prompts to improve our AI models and services.

4.3 User Input

You represent and warrant that you have the right to use any text prompts or images you input into the App, and that such use does not violate any third-party rights.

5. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App.

6. Service Availability and Modifications

6.1 Service Availability

We strive to provide reliable service, but we do not guarantee that the App will be available at all times or free from interruptions.

6.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.

7. Prohibited Uses

You may not use the App:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information

8. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

9. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the App or violation of these Terms.

10. Termination

10.1 Termination by You

You may stop using the App at any time and delete it from your device.

10.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or engage in prohibited conduct.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date and posting the revised Terms within the App. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.

15. Age Restrictions

The App is not intended for use by individuals under the age of 13. By using the App, you represent that you are at least 13 years old.

16. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
